-.- JAISHREE THAKUR J. (ORAL) The instant petition has been filed under Section 439 Cr.P.C for grant of regular bail to the petitioner in case FIR No.13 dated 30.01.2019 under Section 326-A, 120-B, 34 IPC registered at Police Station Cantt., Jalandhar.

Learned counsel appearing on behalf of the petitioner would contend that the petitioner has been in custody since 05.02.2019 and in fact, the matter now stands compromised between the parties as would be evident from the quashing petition No.25047 of 2019, which is now listed for 18.03.2020. It is further contended that co-accused namely Gurdip Singh has already been granted concession of regular bail by this Court, therefore, the petitioner is also entitled to be enlarged on regular bail. Per contra, learned counsel appearing on behalf of the respondent-State opposes the bail application, while contending that the offences alleged against the petitioner are serious in nature, therefore, the petitioner is not entitled to concession of regular bail. CRM-M No.292 of 2020 -2I have heard learned counsel for the parties. Since the trial court is likely to take some time and in view of the fact that the matter stands compromised between the parties and the coaccused has already been granted regular bail by this Court, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal bond and surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein is not to affect the merit of the case.
