Petitioner is a resident of Village Mehrana, Tehsil Charkhi Dadri, District Bhiwani and had invoked Section 7 ejectment jurisdiction under the Punjab Village Common Lands Act,1961 for removal of encroachments in a public street against said encroachers. This Court vide order dated 9.5.2016 had directed the Assistant Collector Ist Grade, Charkhi Dadri, to conclude the pending proceedings within three months. Since the encroachments were not removed hence the present contempt was filed.
Learned State counsel submits that as per last affidavit dated 17.8.2017 filed by Assistant Collector Ist Grade, Charkhi Dadri, the encroachments have since been removed and the vacant possession handed over to the Gram Panchayat. However, it bares out that one of the encroachers Amar Singh son of Mukunda was not impleaded in the writ petition wherein the order dated 9.5.2016 was passed and concededly the Rajinder Parshad Joshi 2018.07.16 16:54 I attest to the accuracy and integrity of this document
COCP 1539/2017 proceedings against him are still pending adjudication before the Assistant Collector Ist Grade, Charkhi Dadri.
In view of the above, no further action is warranted in the present contempt petition.
Disposed of.
Rule is discharged.
