Instant petition has been filed under Section 439 Cr.PC for grant of regular bail to the petitioner in case FIR No.744 dated 18.12.2018 registered under Sections 376(2)(n), 380, 384, 457 and 506 IPC at Police Station Safidon, District Jind.
Learned counsel for the petitioner contends that false and frivolous allegations have been levelled against the petitioner, who has been in custody since 19.12.2018. In fact both the complainant and the petitioner, who are adults, were in a relationship and once the family of the complainant learnt about their affair, instant FIR was lodged against the petitioner. It has also been contended that from the perusal of the testimony of the complainant before the trial court, the factum of her being in a relationship with the petitioner is clearly evident. On the other hand, learned State counsel has opposed the bail application and submitted that there are serious and grave allegations against the petitioner for which he does not deserve the concession of SONIA BURA 2020.01.15 15:49 I attest to the accuracy and integrity of this document chandigarh
CRM-M-481-2020 -2regular bail. He further submits that 6 out of 18 prosecution witnesses including the prosecutrix have been examined. Without commenting on the merits of the case and keeping in view the fact that the petitioner is behind bars since 19.12.2018 and the trial is not likely to be concluded in the near future, no useful purpose would be served by keeping the petitioner in custody. In the circumstances, the present petition is allowed and the petitioner is admitted to bail to the satisfaction of the trial court/Duty Magistrate concerned.
