Main Case This is a petition that has been filed for grant of regular bail in case FIR No.112 dated 10.10.2020 under Sections 379-B, 324, 323, 148, 149 IPC registered at Police Station City Zira, District Ferozepur. Learned counsel for the petitioner would contend that the petitioner had been nominated as an accused on the basis of disclosure statement made by one Malkeet Singh @ Malla, who has already been regular bail by this High Court in the case titled as Malkeet Singh @ Malla Vs. State of Punjab. The investigation is complete and the challan stands presented and therefore, custodial interrogation of the petitioner would no longer be required.

CRM-M No.913 of 2021 (O&M) -2regular bail by contending that no ground for grant of bail to the petitioner is made out, however, she is not in a position to dispute the fact that the petitioner herein was nominated in the said FIR as an accused only on the basis of a disclosure statement made by the co-accused. I have heard learned counsel for the parties. Keeping in view the fact that the petitioner has been nominated in the said matter on the basis of disclosure statement made by the co-accused, who has already been allowed bail by this High Court and he is in custody since 30.11.2020 and the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind bars.

The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/ surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
