The petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.704 dated 13.09.2019 for the offences under Sections 420, 406 and 120-B of the Indian Penal Code registered at Police Station Model Town, District Panipat. I have heard learned counsel for the parties and perused the record.

Petitioner-Gorav Jagga was working as Production Manager in the complainant-company. The recovery of `22,000/- only has been shown from the petitioner. The petitioner has been in custody since 11.10.2019. The case of the present petitioner stands on almost similar footings with that of co-accused Manish Kumar, who has already been HARPAL SINGH PARMAR 2020.01.24 16:41 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-381 of 2020 [2] granted the concession of bail by the learned Additional Sessions Judge, Panipat vide order dated 20.12.2019. It is debatable as to whether the offence of cheating against the petitioner is made out or not. The petitioner is no longer required for further investigation as the challan has already been filed.

The trial of the case is likely to take long time. No useful purpose would be served by keeping the petitioner in custody till the disposal of the case. The case against the petitioner was based on the socalled disclosure statement made by co-accused Manish Kumar, who has already been granted the concession of bail. The offences are triable by the Judicial Magistrate Ist Class.

Keeping in view the above facts and circumstances, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner-Gorav Jagga be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court/Duty Magistrate concerned.

However, it is made clear that above observations may not be construed as an expression of opinion on the merit of the case pending before learned trial Court.
