(ORAL) Through the present contempt petition, the petitioners who were working as Forman Instructors have alleged that there has been wilful disobedience and non-compliance of directions dated 23.1.2013, Annexure P1, ordered in LPA No.977 of 2011, passed by a Division Bench of this Court.

A perusal of the petition indicates that the order implementation of which has been claimed, was challenged before the Apex Court by filing an SLP which was disposed of vide order dated 29.6.2016, Annexure P2, issuing a direction for carrying out the orders of the High Court in accordance with law. COCP-1616-2017 (O&M) matter. The petitioners claim that on interpretation of the order of Hon'ble the Apex Court, they would be entitled to certain service benefits which have been denied.

Before entering into the disputed question of fact whether the petitioners have been deprived of any benefit available to them under the orders of the Court, it is observed here that legal notice Annexure P3 dated 7.3.2017, expressing their grievance which has been sent by the petitioners to the Principal Secretary cum Financial Commissioner, Department of Technical Education, Government of Haryana, has not been decided yet.

This petition is disposed of at pre-mature, at this stage. However, in the interest of justice, a direction is issued to respondent No.1 to pass a speaking order on legal notice Annexure P3, dated 7.3.2017, and communicate the same to the petitioners within a period of three months.
