Geeta Devi v. Ashok Kumar & ANR
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH COCP No. 1669 of 2016 Date of decision : 15.03.2017 Geeta Devi ....Petitioner V/s Ashok Kumar & anr.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. PPS Duggal, Advocate for the petitioner.
Mr. Ram Goklaney, Advocate for the respondents. RAJAN GUPTA J.
Petitioner has preferred present contempt petition for alleged violation of order dated 09.09.2015 passed by Lok Adalat at Ferozepur. It has been urged before the court that respondents have not adhered to the terms of compromise arrived at before the Lok Adalat. Thus, they need to be punished for committing contempt of court. It appears that plaintiff-petitioner filed a suit before the civil court praying that defendants be injuncted from raising any construction on the portion shown in red colour in the site plan. During pendency of civil suit, matter was referred to Lok Adalat. It was stated before the said forum that a compromise had been arrived at. Suit was, thus dismissed as withdrawn. As the plaintiff-petitioner herself withdrew the suit, no case for invoking contempt jurisdiction of this court is made out. Petition is misconceived. Same is hereby dismissed.
