Pursuant to order dated January 12, 2017, Chief Administrator, HUDA, Gurgaon is present in court. Learned State counsel has sought instructions from him and has addressed arguments. According to him, order passed by Single Bench in CWP No. 19927 of 2009 was challenged before the LPA Bench (LPA No. 2096 of 2011) wherein certain guidelines were laid down. Case of the petitioner was considered in light of the guidelines and rejected vide order, Annexure R1.

In view of stand taken before this court, counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to impugn the speaking order.
