Instant petition has been filed under Article 227 of the Constitution of India read with Section 482 Cr.PC praying for stay of the operation of the impugned order dated 19.03.2019 (Annexure P-2) passed in a complaint case dated 16.08.2016.

Learned counsel for the petitioner contends that vide order dated 19.03.2019 (Annexure P-2) learned SDJM, Kalka passed the impugned order granting interim maintenance to the respondent-wife without affording him an opportunity of being heard. The said impugned order was challenged before this Court by way of CWP No.20829 of 2019, which however, was withdrawn by the petitioner with a liberty to raise all the pleas including the ones taken in the writ petition before the Appellate Court. Thereafter, an appeal was preferred before the Appellate Court. However, the appeal has been pending before the learned Addl. Sessions Judge, Panchkula and no decision till date has been taken on the application filed for staying the operation of the impugned order dated 19.03.2019. CRWP-204-2020 -2directions are issued for disposing off the appeal in a fixed time period. I have heard learned counsel for the petitioner and perused the impugned order as well as other relevant record annexed with the petition. Without expressing any opinion on the merits of the case, present petition is disposed of with a direction to the learned Appellate Court before whom the appeal is pending to ensure expeditious disposal of the appeal filed by the petitioner to impugn the order dated 19.03.2019 preferably within a period of three months.
