Through the instant petition, as instituted under Section 482 of the Cr.P.C., prayer is made for issuance of directions upon the respondents No.1 to 3 to: (i) transfer the investigation of FIR No.421 dated 31.10.2019, under Sections 143, 147, 392, 420, 457 and 506 of the IPC, registered at P.S. Civil Line, Jind, District Jind, to a senior IPS Officer; (ii) forthwith arrest the respondents No.5 to 9 in the FIR (supra) and recover the cheated amount of Rs.1,23,00,000/- from their bank accounts; (iii) ensure protection of life and property of the petitioner and her family members.

At the very outset, the learned State counsel, on instructions imparted to him by S.I. Bijender Singh, submits that investigation in the FIR (supra) has already been completed and a Cancellation Report has DEVINDER YADAV 2024.01.10 09:58 I attest to the accuracy and authenticity of this order/judgment

CRM-M-1097-2021 (O&M) 2024:PHHC:001748 also been prepared, which is likely to be presented before the learned Illaqa Magistrate concerned, within two weeks from today. 3.

In view of the submissions made hereinabove by the learned State counsel, this Court does not deem it appropriate to, at this stage, interfere in the matter and grant the asked for reliefs. However, as prayed for by the learned counsel for the petitioner, liberty is granted to the petitioner to raise her grievance(s), if any, before the learned trial Court concerned, through recoursing the apt statutory remedy. Moreover, in case, the petitioner approaches the learned trial Court concerned, through canvassing her grievance in an appropriately instituted application, the latter shall make an appropriate decision upon the same, within the prescribed parameters of law.
