(ORAL) The petitioner- Princedeep Singh has filed the instant petition under Section 482 of Cr.P.C. for quashing of FIR No.194 dated 13.12.2022, under Sections 354-B, 354-D, 341, 506, 120-B of IPC, registered at Police Station Jhabal, District Tarn Taran and all other subsequent proceedings on the basis of compromise between the parties dated 26.12.2022 (Annexure P-2). As per the facts of the case, the complainant - Ranjit Singh gave his statement to the police that the victim is his daughter studying in 11th class at Shri Guru Harkrishan Senior Secondary Public School at Jhabal. On 12.12.2022 at about 3:00 PM his daughter was going towards the van for boarding when Princedeep Singh stopped his car and molested her. His daughter disclosed about
-2this incident. She was forced to talk to him and he also threatened her. On 13.12.2022, Princedeep Singh was wandering outside the school and his daughter informed the family about this fact. She was brought back home from the school. Ultimately the matter was reported to the police and the present FIR was registered.
The petitioner filed this petition for the quashing of aforesaid FIR on the basis of compromise. The petitioner and respondents No.2 & 3 were directed to appear before the trial Court/Illaqa Magistrate for recording their statements on the basis of compromise. The detailed report regarding compromise has been received from the court of Additional Chief Judicial Magistrate, Tarn Taran, dated 13.04.2023. The statements of respondents No.2 & 3 have been recorded, where they confirmed the compromise with the petitioner. They confirmed that this compromise has been effected without any pressure, coercion from any side and they have no objection regarding quashing of FIR. The petitioner-Princedeep Singh also confirmed this fact in his separate statement. The statement of ASI Gurdeep Singh is also recorded who further confirmed that the accused is neither involved in any other case nor has been declared as proclaimed offender.
Therefore, from the report of Additional Chief Judicial Magistrate, Tarn Taran, it is clear that the compromise has been effected between the parties without any pressure, coercion or undue influence, which is acceptable to both the parties. They have mutually settled all their disputes. They will be able to live in peace and harmony. It will end the litigation started between them. No purpose would be served with the continuation of criminal proceedings.
-3Therefore, considering these facts the petition filed by the petitioner is accepted and FIR No.194 dated 13.12.2022, under Sections 354-B, 354-D, 341, 506, 120-B of IPC, registered at Police Station Jhabal, District Tarn Taran and the consequential proceedings arising therefrom are quashed.
