Through this petition, the petitioner seeks regular bail in case bearing FIR No.285 dated 25.07.2021, registered at Police Station City, Jhajjar, under Sections 379-B, 201 and 34 IPC. Learned counsel for the petitioner submits that the petitioner has falsely been involved in the present petition, inasmuch as, the alleged occurrence took place on 24.07.2021, whereas in the supplementary statement of the complainant recorded on 27.07.2021 (Annexure P-3), he has stated that it was on 25.07.2021 when the accused persons gave him AMAN JAIN 2022.05.24 18:00 I attest to the accuracy and authenticity of this order/judgment

CRM-M-1295-2022 (O&M) -2beatings and snatched his e-Rickshaw, mobile phone and cash amount of Rs.4,000/- from his pocket. He further submits that the petitioner has been in custody since 26.07.2021 and that there is no other case registered and/or pending against the petitioner. Per contra, while opposing the prayer for grant of regular bail to the petitioner, learned State counsel does not dispute the custody period of the petitioner and the contradiction in the initial and the supplementary statement of the complainant.

I have heard the learned counsel for the parties. The petitioner has been in custody since 26.07.2021. There is a contradiction in the initial and the supplementary statement of the complainant regarding the date of occurrence. The trial of the case would take a long time to conclude. Therefore, no useful purpose would be served by keeping the petitioner behind the bars. In view of the above and without commenting anything on the merits of the case, lest it should prejudice the case of both the sides, the present petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the learned trial Court/Duty Magistrate/Chief Judicial Magistrate concerned. !
