COCP No. 1369 of 2007 Date of Decision : 13.07.2016 Mewa Singh and others ....Petitioners

Versus

Narender Kaur @ Nachhtro and another ....Respondents

CORAM:

HON'BLE MR. JUSTICE SURINDER GUPTA

Present:

Mr. O.P. Goyal, Senior Advocate with Mr. Mukesh Verma, Advocate for the petitioners.

Mr. P.S. Jammu, Advocate for respondent no. 2.

Surinder Gupta, J.

This petition has been filed by appellants-petitioners Mewa Singh, Sohan Singh and Dharam Singh seeking initiation of contempt proceedings against respondents Narender Kaur and Sant Baba Bhupinder Singh.

While deciding RSAs No. 1440 and 1441 of 1988, it has been held that Swaran Singh was neither owner of suit property nor had entered into agreement to sell the same on behalf of real owner Jagir Kaur. Vide order dated 17.03.2008, parties were directed to maintain status quo with regard to possession and alienation of the suit property. It is nowhere the case of petitioners that they have been dispossessed. Alienation of suit property by Narender Kaur through a gift deed in favour of defendant no. 2 will have its own legal effect but do not call for initiation of any contempt proceedings against respondents.

The rule is discharged.
