Same is taken on record. Learned counsel has referred to Paras 4 and 5 thereof. Same read as under:- "4. 5. That out of the total due amount of Rs.13,33,389/-, an amount of Rs.1,83,389/- is due to be paid to the petitioner. It is pertinent to mention here that the balance due amount of Rs.1,83.389/- shall be paid by the deponent within period of 4 weeks." In view of the above, learned counsel for the petitioner submits that he may be allowed to withdraw this petition with liberty to file afresh, in case, any cause of action subsists.
