(ORAL) In the present writ petition, the grievance which is being raised by the petitioners is that enhanced DA from 90% to 100 % for the period from 01.07.2013 to 31.01.2014 and thereafter, further enhanced from 01.01.2014 to 30.09.2014 as well as enhanced arrears of DA from 100% to 107% for the period 01.07.2014 to 28.02.2015, have not been released to them and the prayer of the petitioner is that direction needs to be issued to the respondents to release the said benefits to the petitioners alongwith interest @ 9% per annum.
Counsel for the petitioners states that for the relief, which has been sought in the present writ petition, petitioners have served the respondents with a legal notice dated 19.11.2019 (Annexure P-4), which NARESH KUMAR 2020.01.10 16:11 I attest to the accuracy and integrity of this document Chandigarh
CWP-312-2020 -2is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice.
Notice of motion.
Keeping in view the advance copy given to the respondents, Mr. Ajaivir Singh, Advocate, accepts notice on behalf of the respondent(s)-University and he states that the respondents have no objection in case the prayer of the petitioners for deciding the legal notice dated 19.11.2019 (Annexure P-4) in a time bound manner is accepted. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 19.11.2019 (Annexure P-4) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.
Present writ petition stands disposed of.
