Petitioner was an aspirant for the post of PGT Physics advertised vide advertisement dated 7.6.2012 issued by Haryana School Teachers Selection Board. Petitioner had four years' teaching experience. He participated in the process of selection and was declared successful as his name appeared in the merit list at Sr.No.426. Later on the Director,Secondary Education,Haryana issued a directive to inquire into the experience certificate of all the aspirants. Since there was some doubt with regard to the experience certificate of the petitioner, he was called upon in this regard and given a personal hearing on 21.7.2014. Since even after giving personal hearing,petitioner did not get any response from the authorities concerned and other aspirants had been issued appointment letters, he approached this Court by way of CWP 12848/2015.

The said writ petition was disposed of by this Court vide order dated 2.7.2015 with a direction to respondent-State to decide the case of the petitioner as indicated in his legal notice dated 18.4.2015 and pass a speaking order Rajinder Parshad Joshi 2017.03.

COCP 1927/2016 within a period of two months from the date of receipt of certified copy of the order. In the event of acceptance of his claim, consequential benefit was ordered to be given to petitioner within a further period of two months.

Now instant contempt has been filed alleging disobedience of order dated 2.7.2015 passed in CWP 12848/2015. Upon notice reply by way of affidavit of ML Kaushik,Director Secondary Education,Haryana has been filed stating therein that legal notice dated 18.4.2015 of the petitioner has been decided and claim of the petitioner having been found to be genuine he has been appointed as PGT (Physics)vide order dated 15.11.2016 w.e.f. 14.12.2013 on notional basis. A copy of the order dated 15.11.2016 has been annexed as Annexure R-1 with the affidavit. At the time of hearing today,learned counsel for the petitioner concedes that the present contempt has become infructuous. Dismissed as having become infructuous.
