JASWANT SINGH, J (ORAL) Petitioner-mother of Rann Singh, who died in harness while working as Conductor with the Haryana Roadways, was seeking the benefits towards release of salary under family pension along with interest arrears under the Financial Assistance Rules 2006 (for short "the Rules") and thereafter sanction of family pension being 95 years old as also the only dependent of the deceased employee.

This Court vide order dated 30.7.2015 directed the respondents-Department to examine the plea of the petitioner and thereafter released the consequential benefits. At the time of hearing today, learned State counsel submits that the entitlement of the petitioner has been accepted vide speaking order dated 27.3.2017, a copy of which has been produced in Court; and payment of Rs.16.94.421/- has been released qua salary under the Rules apart from sanctioning family pension at the rate of Rs.22818/- per month.

In view of the aforesaid stand of the respondents-State,

COCP No.19 of 2017 #2# present contempt petition has become infructuous and the same is dismissed as such and the rule is discharged. However, the petitioner shall be at liberty to revive the petition, in the event of petitioner finding any discrepancy in the aforesaid regard.
