(ORAL ) Through Video Conference The present second petition has been filed under Section 439 of the Code of Criminal Procedure, seeking regular bail in FIR No.50 dated 10.08.2018, under Sections 201, 313, 366, 376, 506 and 509 IPC, registered at Woman Police Station, Panchkula, District Panchkula. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case particularly in view RAJ KUMAR ARORA 2021.01.19 15:17 I attest to the accuracy and integrity of this document

CRM-M-1202-2021 (O&M) of the fact that ingredients of aforesaid sections were not made out because it was a case of consent.

I have heard the learned counsel for the petitioner. The petitioner had earlier also filed a petition for regular bail before this Court taking all the issues which have been raised in the present petition which was dismissed by this Court on 10.11.2020 vide Annexure P-8, by passing a detailed speaking order and by considering the arguments raised by the learned counsel for the petitioner. On a query being put to the learned counsel for the petitioner as to how the present petition would be maintainable when earlier petition for regular bail filed by the petitioner was dismissed about two months ago by a detailed order on merits, he has not been able to show that there is any change of circumstances or there exist any other extra ordinary circumstances for filing the present successive bail application after about two months. In view of above, the present petition is dismissed being not maintainable.
