Challenge in the present petition is to the Kalandra under Section 145 Cr.P.C. submitted under Rapat No. 08 dated 19.10.2023 by the respondent No. 6 viz. the Station House Officer, Mullanpur Dakhan in the Court of Sub Divisional Magistrate, Ludhiana East and also to the consequential orders that have been passed by the Sub Divisional Magistrate, Ludhiana East on the ground that the same are in violation of law since multiple Civil Suits pertaining to the said land are already pending. Counsel for the contesting respondent(s) contends that he would have no objection to the quashing of Kalandra under challenge in the present petition with liberty to the respondent-Sukhminder Kaur to move an appropriate petition for appointment of a Receiver before the Civil Court in the pending civil proceedings.
In view of the above, the present petitions are allowed and the Rapat No.08 dated 19.10.2023, Rapat No.26 dated 20.06.2020 and Rapat No. 12 dated 25.10.2023 are set aside with liberty as aforesaid. Needless to
