(ORAL ) Through Video Conference The present second petition has been filed under Section 439 of the Code of Criminal Procedure, seeking regular bail in FIR No.120 dated 21.8.2020, under Sections 148, 149, 427 and 506 IPC, registered at Police Station Sector 20, Panchkula.
Learned counsel for the petitioner has submitted that in the present case the petitioner has been falsely implicated and he was not RAJ KUMAR ARORA 2021.01.15 15:07 I attest to the accuracy and integrity of this document
CRM-M-909-2021 (O&M) named in the FIR. At the outset, it is submitted that 8 persons were arrested during the course of investigation and 5 of them have already been granted bail.
Learned State counsel has admitted that 5 accused have been granted bail. So far as parity with other co-accused of the petitioner is concerned, the same has also not been disputed by the learned State counsel. Learned counsel for the petitioner has further submitted that investigation is complete and challan in the present case has already been presented and therefore, no useful purpose would be served in case the petitioner is kept behind bars.
In view of above without commenting anything on the merits of the case, the present petition is allowed. It is ordered that the petitioner shall be released on bail on furnishing bail bond/surety bond to the satisfaction of the concerned trial Court/Duty Magistrate. However, anything observed hereinabove shall not be treated as an expression of opinion on merits of the case and is meant only for the purpose of decision of present petition. January 14, 2021.
