Jaswant Singh,J(Oral) Petitioner-plaintiff had filed a civil suit challenging the order dated 5.7.2011 whereby punishment of dismissal from service,on completion of disciplinary proceedings, was imposed upon the petitioner by employer-Housefed. The said suit was decreed vide order dated 27.10.2014 with liberty granted to defendant-employer to start a fresh enquiry for the same charges within thirty days. The appeal filed by defendant-employer is stated to have been dismissed on 30.1.2016. It is claimed that no fresh enquiry was initiated by the employer in terms of the liberty granted by the Courts. The respondents, in fact, are stated to have reinstated the petitioner while deciding to settle the remaining claims on decision by the appellate court. Reference is made to order dated 7.7.

2015(Annexure P-3) passed by the Managing Director, Housefed to that effect. In the present contempt it is claimed that the undertaking given vide order dated 7.7.2015 having not been enforced amounts to contempt of the orders passed by the trial court while passing the decree. COCP 191/2017 Heard learned counsel for the petitioner.

In the given facts, no contempt would be made out. After arguing for sometime, learned counsel for the petitioner prays for permission to withdraw the present contempt petition with liberty to petitioner to seek his remedy in accordance with law.
