-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of regular bail in case having FIR No.100 dated 5.5.2004 registered under Sections 307, 323, 324, 326, 148, 149 IPC at Police Station City Hoshiarpur now Police Station Model Town, District Hoshiarpur.

The counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in the present case and is in custody since 26.10.2022 and the co-accused who faced trial are already acquitted vide judgments (Annexures P-2 & P-3) passed by the learned trial Court. ( 2 ) CRM-M-1186-2023 The instant petition is opposed by the State counsel, who submits that earlier the petitioner was declared as proclaimed offender and was arrested on 26.10.2022. However, the State counsel has not disputed the fact that other accused who faced trial are acquitted by the trial Court vide two separate judgments, Annexures P-2 and P-3 as the injured failed to support the case of prosecution.

I have considered the submissions made by counsel for the parties.

In view of the above, no purpose is going to be served by keeping the accused behind the bars for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
