JUSTICE JASWANT SINGH Present:- Mr.VD Sharma,Advocate for the petitioner Mr.Prateek Mahajan,Advocate for the respondents. *** JASWANT SINGH, J.(ORAL) Petitioner was one of the 19 petitioners, working on the post of Fitter/Wireman with erstwhile HSEB i.e. predecessor of UHBVNL, who filed CWP 2858/1994 seeking revision of pay scale in the pay scale of Rs.1200-2040 w.e.f. 1.5.1990. The said writ petition was disposed of vide order dated 27.4.2012 in terms of order passed in CWP 2060/2011 (decided on 23.8.2011).

In CWP 2060/2011 identically situated petitioners were held entitled for the said relief and respondents were directed to refix the pay of petitioners by granting them revised pay scale of Rs.1200-2040 w.e.f. 1.5.1990 or the dates of their appointment(whichever is later)within six months of receipt of certified copy of the order. However, arrears were restricted to the period of 36 months preceding the filing of the writ petition. COCP 2014/2015 dated 27.4.2012(P-1) passed in CWP 2858/1994. Upon notice, short reply by way of affidavit of Vijendra Singh, Xen, OP Division, DHBVN,Charkhi Dadri has been filed stating therein that after refixation of pay of petitioner in compliance of judgment dated 27.4.2012, due arrears have been paid to him vide cheque dated 19.12.2016. A copy of cheque and payment vouchers have been annexed with the reply as Annexures R-1 and R-2.

At the time of hearing counsel for the petitioner concedes that with the compliance of order dated 27.4.2012, the instant contempt has been rendered infructuous.

Dismissed as infructuous.
