Prayer in CM No.11435-CWP of 2021 is for withdrawal of the writ petition in view of the compromise arrived at between the petitioners and respondents No.4 and 5 on 28.02.2021. Copy thereof is attached as Annexure A with the application.

Learned counsel for non-applicant/respondents No.4 and 5 affirms and verifies the factum of the settlement between the parties. At request and with consent of learned counsel for the parties, hearing of the writ petition is preponed from 14.12.2021 for today itself. Dispute in the writ petition was that Kusum Pal, husband of petitioner No.1 and son of respondents No.4 and 5, had died while serving the Indo-Tibetan Border Police (ITBP). CWP No.585 of 2021(O&M) [2] deceased being nominees and beneficiaries of the amounts in the bank/policy of post office/gratuity, had received certain amounts. Petitioners by way of filing this writ petition had sought apportionment of the amounts in question. Matter is stated to have been amicably resolved by the parties on 28.02.2021.

In this view of the matter, petitioners seek to withdraw this writ petition.

Writ petition is accordingly dismissed as withdrawn. Application is disposed of.
