% ) All these three petitions under Section 11(6) of the Arbitration and Conciliation Act, 1996 have been filed by the petitioner to constitute an independent and impartial Arbitral Tribunal to resolve the dispute(s) arising out of tenders dated 13.11.2006, 14.11.2006 and 30.07.2006. On 10.05.2024 this Court had noticed the Arbitration Clause 67 (GCC 25.3) and the fact that Justice Pradeep Nandrajog, former Chief Justice of Bombay High Court had been appointed as the nominee Arbitrator on behalf of the petitioner. Resultantly, a proposal had been made to appoint Justice Mukul Mudgal, former Chief Justice of this Court, as the second Arbitrator on behalf of the respondents and accordingly necessary declaration as required under Section 12(5) of the Act of 1996 was sought for from the proposed arbitrator.

It has now been informed that necessary declaration under Section 12(5) of the Act of 1996 sought from Justice Mukul Mudgal, former Chief Justice of this Court has been duly received. 4.

In view of the above, all the three petitions stand disposed of. The order dated 10.05.2024 passed by this Court is made absolute. The two above named Arbitrators shall proceed to nominate the third arbitrator in accordance with the procedure prescribed as agreed to between the parties. The arbitration proceedings will be held within the State of Haryana i.e. Gurugram.
