*** Daya Chaudhary, J. (Oral) The present contempt petition has been filed for noncompliance of order passed by the Division Bench of this Court on 17.07.2017 in CWP No.15252 of 2017.
Vide order dated 17.07.2017, a direction was issued to the Collector, before whom petition under Section 11 of the Punjab Village Common Lands (Regulation) Act, 1961 was pending, to decide the stay application within a period of one month . Similarly a direction was also issued to the Appellate Authority, before whom the petitioner has challenged the order of eviction, to decide the stay application within a period of one month and till such time, the status quo re: possession was ordered to be maintained.
After hearing arguments of learned counsel for the petitioner, it is apparent that admittedly the petitioner has not been dispossessed and still time is there for taking decision on the application as it was to be decided Neetu Rani 2017.08.02 11:00 I attest to the accuracy and authenticity of this document Chandigarh
COCP No.1995 of 2017 within a period of one month from 17.07.2017 i.e. upto 16.08.2017. Hence, no contempt is made out.
However, the petitioner is at liberty to approach the concerned authorities in case, he is dispossessed or stay application is not decided within the time specified by the Division Bench of this Court. Disposed of accordingly.
