Chauhan, Advocate for the petitioners. ***** HARKESH MANUJA, J (ORAL) Short prayer made in the petition under Section 482 Cr.P.C is that the cancellation report presented by the Investigating Agency in FIR No.0029, dated 08.03.2020 under Sections 448, 511 IPC, registered at Police Station Mahilpur, District Hoshiarpur, is pending before the Court of learned JMIC, Garhshankar, District Hoshiarpur for consideration for the past 07 months.

I have perused the zimini orders passed in the proceedings pending before the learned JMIC Garhshankar which show that the cancellation report in the afore-mentioned FIR was submitted on 05.05.2022 wherein the complainant appeared and submitted his nonsatisfaction to the same, resulting into listing of the cancellation report for consideration by the trial Court. For the past almost seven months no final decision has been taken upon the cancellation report by the learned JMIC, Garhshankar.

CRM-M-734-2023 of the petition the same is disposed of with a direction to the learned trial Court i.e. JMIC, Garhshankar to take a final decision on the cancellation report presented before it either on the date fixed i.e. 21.01.2023 or any other convenient date, preferably within a period of four weeks thereafter. Keeping in view the nature of proceedings, the present petition is being decided without issuing notice to respondent No.2, lest it may delay the proceedings before the trial Court.
