(Oral) The petitioner alleges violation of the order dated 12.09.2012 vide which in RSA No.4156 of 2011, it was directed that the dispossession of the appellant shall remain stayed. It is noticed in the aforesaid order that the respondent - Gram Panchayat has filed a suit for declaration that it is owner in possession of the suit land and the consent decree dated 23.05.1997 in favour of the petitioner is liable to be set-aside. Both the Courts below have concurrently held that it is the land belonging to the Gram Panchayat and have set-aside the decree. At this stage, counsel for the petitioner seeks permission to withdraw this petition with liberty to the petitioner to avail the alternative remedy in accordance with law.
