One annual increment of petitioner, who is working as Assistant Lineman with UHBVNL, without cumulative effect was stopped without holding any enquiry. Aggrieved against the same, he filed CWP 8296/2014 which was allowed by this Court vide order dated 20.1.2015 and the impugned punishment order was set aside. In the present contempt, petitioner has alleged that despite order dated 20.1.2015 passed by this Court, the punishment order still stands in his ACR.

Upon notice, reply by way of affidavit dated 14.2.2017 of respondent/contemner has been filed stating therein that vide order dated 4.11.2016 the order dated 20.1.2015 passed by this Court has been complied with and consequential benefits released to the Rajinder Parshad Joshi 2017.02.18 15:51 I attest to the accuracy and integrity of this document

COCP 2121/2016 2 230 petitioner. In support, reliance has been placed on a sworn affidavit(R4) dated 15.11.2016 of the petitioner wherein it is stated that he has received a sum of Rs.48435/- towards arrears of increment and has been held entitled for ACP scale. It is further stated that no dues are outstanding against the employer and he shall be withdrawing the present contempt petition.

At the time of hearing,no one has put in appearance on behalf of the petitioner.

In view of the reply filed on behalf of respondents supported by affidavit (R-4) of the petitioner, in my considered view, substantial compliance of the order dated 20.1.2015 passed by this Court has been made warranting no further proceedings in the present contempt petition.

Rule is discharged.
