Petitioner-Society filed CWP 5692/2016 seeking a direction to respondents to release the payments in respect of various construction works executed by it. The said writ petition was disposed of vide order dated 18.5.2016 directing the respondents to release the payment of the petitioner as early as possible but preferably within a period of two months.

Now alleging disobedience of said order instant contempt has been filed.

COCP 2165/2016 2 has been filed detailing therein the number of 5 works allotted to the petitioner-society. It is stated that payments of those work which stand completed have already been made whereas payments in respect of incomplete works will be released on completion of the works allotted to the petitioner-society. Thus, claim of petitioner to some extent is disputed.

In view of the affidavit stated above, the instant contempt is dismissed as infructuous. However, petitioner, if so advised, may seek remedy in accordance with law.
