Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.166 dated 02.11.2018 under Sections 420, 120-B IPC, registered at Police Station Kamboj, District Amritsar.
Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. The FIR in the present case was registered on the basis of VINEET GULATI 2019.07.03 15:07 I attest to the accuracy and authenticity of this document Chandigarh written complaint made by Dharamvir. As per the allegations, present
CRM No.M-793 of 2019 -2petitioner along with his wife, was property dealer and they entered into agreement to sell with the complainant. As per the allegations, accused had taken `23,36,000/- from the complainant but on enquiry, it was found that no such property was existing.
Learned counsel for the complainant has placed on record photocopies of FIRs bearing No.235, 239, 0021. There is also reference that there are other FIRs also under Section 420 IPC against present petitioner.
Keeping in view the facts and circumstance of the present case and in view of number of FIRs against the petitioner showing that he is habitual offender, I find that petitioner is required for custodial interrogation and no ground is made out for granting benefit of anticipatory bail to him. Therefore, finding no merit in the present petition, the same is dismissed.
