NIRMALJIT KAUR, J. (ORAL) The contempt is filed for non-compliance and violation of the order dated 04.08.2000 vide which interim directions were issued restraining the respondents from discharging any sullage or rain water into the Jargari drain, Village Jargari, Tehsil Payal, District Ludhiana. On 06.03.2019, learned counsel for respondent No.5 stated that the plan was submitted way back in the year 2003 and thereafter, the estimate was also provided to M.C. Khanna stating that `140.77 lakhs was required for covering 1.91 KM of drain and that the Municipal Council on their part have done nothing.

Learned counsel appearing for the Municipal Council, however, stated that they do not have the funds to cover the drain and the funds have to be given by the State Government to the Board to execute the work. Accordingly, while taking a serious view, this Court vide order dated 06.03.2019 directed the respondents to have a meeting prior to the MEENU 2019.04.04 10:58 I attest to the accuracy and authenticity of this document chandigarh

In pursuance to the order dated 06.03.2019, Mr.Kulwinder Singh, M.E. on behalf of respondent Nos.1 to 3- MC Khanna and S/Sh. G.P.Singh, EE and S.S.Dhindsa, SE for respondent No.4 are present and have placed on record the work order, i.e. letter No.883, dated 06.03.2019, given to the successful contractor with a stipulation that the time-limit for completion of the work shall be 12 months.

In view of the satisfactory progress, although much delayed, i.e., the work order having been allotted and `1644.26 lakhs having been sanctioned for the entire work including construction of the sewerage plant as well as construction of the drain and the same shall be completed within the stipulated period as mentioned in the work order, the contempt petition is dismissed.

Rule issued against the respondents stand discharged. The respondents shall ensure that the needful be done as expeditiously as possible.

Since the main case has been dismissed, the application has become infructuous and is disposed of as such. April 01, 2019 ( NIRMALJIT KAUR ) meenuss JUDGE 1.
