The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to issue him passport.

The petitioner has applied for passport vide application dated 23.10.2023. The petitioner has got admission for MBBS in Russia. No criminal case is pending against the petitioner, thus, respondents have no right to withhold the passport.

Ms. Amrita Singh, Central Government Counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before passport authority and as and when he appears before passport authority, passport would be issued within two weeks thereafter. In wake of statement of counsel for Union of India, the petition stands disposed of. The petitioner is directed to appear before passport authority on 18.01.2024. On doing so, the passport authority would pass an appropriate order within two weeks from 18.01.2024.
