(ORAL) Through this petition under Section 439(2) Cr.P.C. prayer has been made for setting aside order dated 31.12.2018, granting regular bail to respondent No.2, in case FIR No.0094 dated 08.10.2018 registered under Sections 304 and 34 IPC at Police Station Dhariwal, District Gurdaspur. Learned counsel for the petitioner inter alia contends that learned Additional Sessions Judge, Gurdaspur, illegally allowed the bail application of respondent No.2 vide impugned order dated 31.12.2018 (Annexure P-3), ignoring the fact that bail application of co-accused Jaspal Singh with lesser role in comparison to respondent No.2, was rejected by learned Sessions Judge, Gurdaspur.
