Petitioner has invoked the contempt jurisdiction of this court alleging violations of undertaking given by respondent before the court below that he would pay the cheque amount. I am of the considered view that no case for interference in contempt jurisdiction is made out. A perusal of the undertaking shows that it was also stated by the respondent that in case of default, he had no objection if he is prosecuted under section 138 of the Negotiable Instruments Act.
