*** JASWANT SINGH, J.(ORAL) Alleging willful disobedience of Order dated 11.2.2016 (P.1) passed by this Court in CWP No.21136 of 2011, the petitioner, who was working as an Assistant with respondent No.1-Food Corporation of India, has filed this Contempt Petition contending that inspite of specific direction to the Punishing Authority to pass a fresh order in accordance with law after considering the impact of the judgment/decree dated 21.8.2009 (P.9) passed by the Civil Court, no decision has been taken.

Upon notice, short reply by way of affidavit dated 10.11.2016 of Bhagwan Shanker son of Sudama Ram Chaurasia, IAS Executive Director, North Zone, Food Corporation of India, has been filed asserting that in compliance of the order passed by this Court, a fresh order No.24/2016 dated 08.11.2016 modifying the

COCP No.2282 of 2016 #2# earlier penalty of recovery of Rs.2,75,000/ to "Censure" thereby rendering the present petition as infructuous. Learned counsel for the petitioner has not disputed the aforesaid fact.

In view of aforesaid, no further action is warranted. Accordingly, the present petition is dismissed as infructuous and the rule is discharged.
