**** HARNARESH SINGH GILL , J. (ORAL) The petitioner seeks regular bail in FIR No. 138 dated 28.12.2018 under Sections 15 and 29 of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station City-2, Malerkotla, District Sangrur.
Learned counsel for the petitioner submits that on the secret information, raid was conducted in the house of Mohd. Deen on 28.12.2018 but the petitioner was not arrested on the spot rather, he was arrested on 24.8.2019 and no recovery was effected from him. He further submits that the petitioner has been in custody since 24.8.2019. Learned State counsel, on instructions from ASI Nirmal Singh, submits that in the present case charge has been framed on 20.12.2019 but no prosecution witness has been examined yet. The petitioner has been in custody since 24.8.2019. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
