Prayer in the present petition, filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is for grant of regular bail to the petitioner, in case FIR No.93 dated 12.12.2023, under Sections 302, 34, 201 IPC, registered at Police Station Khanauri, District Sangrur. Shorn of unnecessary details, the case of the prosecution revolves around death of Neha daughter of Sher Singh. Petitioner is brother of said Sher Singh and paternal uncle of deceased Neha. The FIR was registered in the present case on the basis of secret information. As per prosecution version, Neha was in love with a boy of Banga but his father wanted her to marry someone else. So, he got her engaged to a boy of Village Chander in Haryana. Neha did not want to get married according to his father's choice. On 26.10.2023, a teacher from Neha's school informed her family that one boy was standing outside the school and Neha wanted to

run away with that boy from school itself. It spread in the village and family of Neha felt insulted. Neha's father, along with his brother Vikram Singh (petitioner), committed murder of Neha by hanging her to fan with her dupatta and also cremated her on the same day. During investigation, wife of Sher Singh namely Sukhvir Kaur (mother of deceased Neha) got recorded her statement that her husband and brother-in-law (Devar) namely Vikram Singh had killed Neha by hanging her to fan. Both the accused Sher Singh and Vikram Singh were arrested on 12.12.2023 Learned counsel for petitioner contended that wrong information was given by mother of deceased to fix her husband Sher Singh and his family as there was matrimonial dispute between them.

She had given false information in her statement before learned Judicial Magistrate under Section 164 Cr.P.C., but when she appeared as a witness before the Court, she completely resiled from her previous version and stated that her daughter had died due to heart attack and there was no foul play. The petitioner was not involved in any illegal act. There was no eye-witness to the alleged incident. Learned counsel further submitted that the petitioner is not having any criminal antecedents and is in custody since 13.12.2023. The conclusion of trial of the case is likely to take considerable time. No useful purpose would be served by detaining the petitioner in further custody. He, therefore, prayed that the petitioner be granted concession of regular bail. Status Report dated 05.07.

2025 has already been filed by learned State counsel on the last date of hearing. Custody Certificate dated 22.07.2025 has been filed today in Court by learned State counsel, which is taken on record.

Learned State counsel strongly opposed the present bail petition while contending that there are serious allegations against the petitioner regarding committing murder of his niece Neha along with co-accused and it is a case of honour killing. Keeping in view the gravity of offence, prayer for dismissal of present petition has been made. I have heard the learned counsel for the parties and have also gone through the case file.

As per the FIR, there are specific allegations against the petitioner, who happens to be the paternal uncle (Chacha) of deceased Neha that he along with co-accused Sher Singh - father of deceased Neha committed murder of Neha as she was in love with some boy from Banga and she refused to marry the boy, with whom her father - Sher Singh had got her engaged. The complainant in this case is Sukhvir Kaur, who is mother of deceased Neha, who had levelled serious allegations regarding murder of Neha by petitioner Vikram Singh - her brother-in-law (Devar) and her husband Sher Singh.

It has been stressed by learned counsel for the petitioner that Sukhvir Kaur, when examined in this case, had not supported the prosecution version and had resiled from her earlier version and was declared hostile, which strengthens his plea that the petitioner had been falsely implicated in the present case, at instance of complainant Sukhvir Kaur, who was having some matrimonial dispute with her husband Sher Singh. However, this Court does not find any substance in the aforesaid contention raised by learned counsel for the petitioner.

material/evidence produced on record is yet to be evaluated. In her statement recorded under Section 164 Cr.P.C. before the learned Illaqa Magistrate, which is admittedly signed by her, she has levelled serious allegations regarding murder of Neha (her daughter), upon the petitioner and her husband - Sher Singh. The other prosecution witnesses are yet to be examined and final adjudication is to be made in this case after appreciating the entire evidence on record. At this stage, when there are serious and grave allegations against the petitioner, who is paternal uncle of the deceased, regarding committing her murder, then the petitioner is not held entitled for concession of bail.
