Four petitioners accused of offences, inter alia, under the POCSO Act, claim that the respondent police authorities have violated the direction dated 12.1.2009 passed by CRM-M 18244/2008. It is apparent that the decision dated 12.1.2009 provided strict compliance of the instructions dated 1.4.2008 passed by DGP Punjab generally prohibiting conduct of repeated inquiries at the instance of the accused or the complainant by the same District Police after registration of FIRs or filing of complaints. Further inquiries were permitted under certain circumstances.
At the time of hearing Mr.Manoj Bajaj,Addl.AG Punjab on instructions from Mr.Yogi Rai, DSP Malerkotla states that challan against persons accused stands filed on 6.1.2018 for gang rape and under Section 4 of the POCSO Act.
