Petitioner, who sought voluntary retirement from the service of New India Assurance Company filed CWP 1615/2015 seeking benefit of five years of service towards pensionary benefits in terms of Rule 30(5) of the General Insurance(Employees)Pension Scheme,1995. The said writ petition was allowed by this Court vide order dated 6.1.2016 directing release of consequential benefits upto 30.6.2016,failing which the petitioner was held entitled to claim the due amount with interest @ 7% per annum with effect from 1.7.2016. Alleging non-compliance of order dated 6.1.2016 instant contempt has been filed.

Notice of motion was issued.

COCP 2411/2016 Respondents entered appearance and filed short reply. At the time of hearing today,learned counsel for the respondents states that the instant contempt has been rendered infructuous as the order dated 6.1.2016 stands complied with. Learned counsel for the petitionersdoes not dispute the submission made by learned counsel for respondents.

Dismissed as infructuous.
