Present:

Mr.Inderjit Sharma, Advocate, for the petitioner. Mr.V.Ramswaroop, Addl.A.G., Punjab Rajan Gupta, J (Oral) Pursuant to order dated 16.12.2016, Dr.H.S.Bali, Director, Health & Family Welfare, Punjab is present in court. Learned State counsel has sought instructions from him and submits that utmost care shall be taken in future when personal appearance of the officer is called. He submits that his non-appearance was unintentional and inadvertent. Explanation is accepted. A short reply by way of affidavit has also been filed in court. Same is taken on record. Para 6 thereof reads as under:- "That in response to the above letter the S.M.O. Incharge P.H.C Khui Khera, submitted the case of the petitioner in the office of the answering deponent on 30.11.2016. On the receipt of the above, the case of the petitioner for allotment of GPF account was dealt with and the GPF No.DHS-Pb-Class IV-15447 has been allotted on 6.12.2016 (Annexure R-1/1)."

Learned State counsel submits that petitioner shall be intimated the date from which she has been regularised in service. In view of above, no cause of action survives in this petition and same is hereby dismissed as having been rendered infructuous. (Rajan Gupta) Judge December 19, 2016.
