Notice of motion.

On the asking of court, Mr. Vikas Mohan Gupta, Addl. A.G. Punjab, who is present in court, accepts notice. Petitioner alleges violation of order dated November 16, 2016 passed by writ court, operative part thereof reads as under:- "In view of the above, the present petition is allowed and the impugned order dated 02.05.2016 (P-27) is set-aside. The petitioner is held to be entitled to the benefits of regularization w.e.f. 23.01.2001. All the consequential benefits shall be released to the petitioner within six months from today. Disposed of in the above terms."

At the outset, learned State counsel submits that in case no appeal is pending, order passed by writ court shall be implemented at the earliest, in any case not later than three months. COCP No. 2365 of 2017 In case needful is not done, fresh cause of action shall accrue to the petitioner. In such eventuality, this court shall consider imposition of exemplary costs which shall be deducted from the salary of the official(s) responsible for the delay/non-compliance.
