*** ARUN MONGA, J. (ORAL) Petition herein filed under Section 482 Cr.P.C. is for quashing of FIR No.114 dated 07.07.2018 registered under Sections 452, 324, 323, 308, 325, 326, 34 IPC at Police Station, City Batala, and all consequential proceedings arising therefrom.
At the very outset, on a Court query as to why the FIR should not be quashed on the ground of not filing the challan given that FIR was registered way back on 07.07.2018. It has been more than 5 years and due to lackadaisical and nonchalant approach of the prosecution, nothing has moved ever since, learned State counsel under instructions of ASI Surender Singh submits that in fact delay in filing the challan is not intentional and matter is since under investigation and in course thereof, it was found that out of 3 accused, two accused namely, Sagar Sehdev and Rohit Sehdev are innocent and no case is made out against them. Closure report is in process of being finalized and will be filed in due course before the competent Court.
Being so, petitioner Sagar Sehdev has since already been declared innocent by Investigating agency, no proceedings are required. VANDANA 2023.09.14 14:04 I attest to the accuracy and integrity of this document
