Petitioner-Balwinder Singh working as Senior Surveyor in the office of Executive Engineer,Water Resource, Investigation Division,Punjab filed CWP 25014 of 2015 seeking a direction to respondent State to grant him pay scale of Rs.1800-3200 besides fixed local travelling allowance on the basis of order dated 15.5.2009 passed by this Court in CWP 13330/1994 titled Darshan Singh v State of Punjab, wherein the said benefit was given to Surveyors working in Irrigation Department at par with Surveyors working in the Soil Conservation Department.

The said writ petition filed by the petitioner was disposed of by this Court vide order dated 1.12.2015 with a direction to respondent herein to decide the legal notice dated 20.10.2015 served by Rajinder Parshad Joshi 2017.03.08 10:09 I attest to the accuracy and integrity of this document

COCP 2441/2016 the petitioner within a period of 3 months from the date of receipt of certified copy of the order and in case the petitioner was found entitled, to make payment within two months thereafter. In case of disentitlement, a reasoned order was to be passed and conveyed to the petitioner.

Alleging disobedience of said order dated 1.12.2015 instant contempt has been filed.

Upon notice, reply by way of affidavit dated 15.12.2016 of respondent herein has been filed wherein it is stated that in compliance of the order dated 1.12.2015 passed by this Court, the legal notice dated 20.10.2015 of the petitioner has been decided by passing a speaking order and conveyed to petitioner. A copy of order so passed has been annexed with the reply as Annexure R-1. The details of payments made to petitioner in terms of order R-1 has also been given. For the delay caused in complying with the order dated 1.12.2015, unconditional apology has been tendered.

In view of the contents of the reply, counsel for the petitioner concedes that the instant contempt has been rendered infructuous and no further orders are required to be passed. Dismissed as infructuous.
