Petitioners- working as Surveyors in the Irrigation Department,Punjab by filing CWP 26995/2015 claimed parity of pay and pay scales with the Surveyors in their counterpart department in the Soil Conservation. The claim was based on the decision of this Court in Darshan Singh v State of Punjab and others;2009(4)SCT 162. The said writ petition filed by the petitioners was disposed of by this Court vide order dated 7.1.2016 with a direction to respondents to decide the legal notice served by the petitioners within a period of 3 months from the date of receipt of certified copy of the order and in case the petitioners were found entitled, to make payment within two months thereafter. COCP 2442/2016 Alleging partial compliance of order dated 7.1.2016 instant contempt has been filed.

Upon notice, reply by way of affidavit dated 7.12.2016 of Jagdish Kumar Arya,Executive Engineer,Water Resources Investigation Division,Punjab has been filed wherein it is stated that in compliance of the order dated 7.1.2016 passed by this Court, the legal notice of the petitioners has been decided by passing a speaking order bearing endorsement dated 17.11.2016 and conveyed to petitioner. A copy of order so passed has been annexed with the reply as Annexure R-1. The details of payments made to petitioners in terms of order R-1 has also been given. For the delay caused in complying with the order dated 7.1.2016, unconditional apology has been tendered. In view of the contents of the reply, counsel for the petitioners concedes that the instant contempt has been rendered infructuous and no further orders are required to be passed. Dismissed as infructuous.
