Instant petition has been filed under Section 438 Cr.P.C seeking grant of anticipatory bail to the petitioner in case FIR No.450 dated 13.10.2019 registered under Sections 323, 498-A, 506 of Indian Penal Code, 1860 at Police Station Baldev Nagar, District Ambala (Annexure P-1).

On 24.11.2021, following order was passed:- "Heard through video conferencing.

Status report filed by way of an affidavit of Deputy

{2} Superintendent of Police (Hqs), Ambala, has been filed on behalf of respondent No.1-State, which is taken on record. Upon instructions from ASI Lal Chand, State counsel submits that though the petitioner has joined the investigation but some articles are yet to be recovered from him, as per the list supplied by State counsel to counsel for the petitioner. A copy of the list is retained on the record.

Let the petitioner rejoin the investigation on 13.12.2021 at 11.00 a.m., at Police Station Baldev Nagar, Ambala and return the dowry articles which continue to be in his possession.

It is made clear that in case the petitioner does not return the articles, the interim protection granted to him, shall be liable to be vacated.

List on 08.02.2022.

Interim order to continue."

Upon instructions from ASI Lal Chand, State counsel submits that the petitioner has neither joined the investigation nor has he returned the articles, which are in his possession.

When confronted with the situation, counsel for the petitioner has sought permission to withdraw the petition. Permitted to do so.
