Petitioners, who are working as Surveyors in the office of Water Resources and Investigation Division filed CWP 21180/2010 seeking parity with the Surveyors working in the Department of Soil Conservation.
The said writ petition was disposed of vide order dated 1.6.2011 with a direction to respondents to settle the claim of the petitioners within two months.
Alleging disobedience of said order dated 1.6.2011 COCP 2598/2011 was filed which was disposed of vide order dated 23.5.2012 with liberty to those petitioners whose claim were rejected to challenge the action of respondents before an appropriate forum,if so advised. It was further observed that those of the petitioners to whom the benefits have been granted and if still they are aggrieved, they may make a representation to the competent authority, who shall consider and dispose of the same in accordance with law.
In the present contempt it is grievance of the petitioners Rajinder Parshad Joshi 2017.03.28 16:12 I attest to the accuracy and integrity of this document
COCP 2480/2016 that after a lapse of five years petitioners have been granted the claimed pay scale but still no arrears have been paid. On 7.3.2017 the following order was passed:- "Learned State counsel submits that the amounts have been sanctioned, however, the payment is being released and he prays for two weeks accommodation.
List on 28.3.2017.
To be shown in the urgent list."
At the time of hearing today, short affidavit of Adarsh Kumar Bansal,holding the charge of Chief Engineer/ Drainage,Irrigation Works,Punjab has been filed. The same is taken on record.
It is stated in the short affidavit filed today that payments due to the petitioners have been released on 13.2.2017 and 28.2.2017 respectively.
Learned counsel for the petitioner in view of the contents of affidavit filed today, concedes that the instant contempt petition has been rendered infructuous.
Dismissed as having become infructuous.
