Gamdoor Singh v. Gurtej
CR-212-2020 (O&M)
IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH
CR-212-2020 (O&M) Date of decision: March 13, 2023 Gamdoor Singh ....Petitioner versus Gurtej ....Respondent CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present:- None for petitioner.
***** ARUN MONGA, J. (ORAL) Present revision petition is to set aside impugned order dated 12.12.2019 passed by learned Civil Judge (Junior Division), Fazilka whereby in a suit instituted by respondent for recovery on the basis of pronote and receipt, application filed by plaintiff-respondent for leading rebuttal evidence, was allowed. 2.
Matter was taken up for hearing on 13.01.2020 when notice of motion was issued. Office report reveals that notice could not be issued due to non-filing of requisite fee. On the other hand, none appears on behalf of petitioner-defendant. It appears that revision petition which was filed in the year-2020 against impugned order dated 12.12.2019 allowing the application of plaintiff-respondent for leading rebuttal evidence, has been rendered infructuous by sheer passage of time. 3.
Be that as it may, revision petition is dismissed in default. 4.
Pending application(s), if any, shall also stand disposed of. (ARUN MONGA) JUDGE March 13, 2023 mahavir Whether speaking/reasoned:
