Petitioner filed CWP 25242/2012 seeking release of retiral benefits.During the pendency of said writ petition his retiral benefits were released. Since there was delay in release of the retiral benefits, respondents were directed to pay interest within three months from the date of receipt of a certified copy of the order. Further direction was to pass appropriate order for release of full pension as the petitioner had rendered 31 years of service and for full pension, minimum qualying service stood reduced to 25 years. The writ petition stood allowed vide order dated 5.8.2016.

Alleging disobedience of said order dated 5.8.2016 instant contempt has been filed.

Upon notice, short reply by way of affidavit of respondent no.2 dated 25.4.2017 has been filed today stating therein that interest to the tune of Rs.43122.45 has been paid to the petitioner vide letter dated 22.2.2017(R-2/2). As regards grant of full pension in view of Rajinder Parshad Joshi 2017.04.27 18:01 I attest to the accuracy and integrity of this document

COCP 244/2017 instructions dated 15.12.2011 whereby qualifying service for full pensionary benefits was reduced to 25 years, it is submitted that in this regard a speaking order dated 19.4.2017(R-2/1) has also been passed. The said affidavit is taken on record.

In view of the contents of affidavit taken on record today, it is apparent that full compliance of order dated 5.8.2016 has been made rendering instant contempt infructuous.
