Prayer in this petition is for grant of anticipatory bail under Section 438 Cr.P.C in case FIR No.0137 dated 24.05.2023 registered under Sections 148, 149, 307, 323, 506 of the IPC and Section 25 of Arms Act registered at Police Station Mundkati, District Palwal.

As per prosecution allegations, petitioners along with others arrived to the agricultural land/fields of the complainant and attacked them resulting into injuries to the other party including a firearm injury to Vakil. Learned counsel contends that the firearm injury is attributed to Aamin; whereas other co-accused and the petitioners are alleged to have simply given injuries to others. Learned counsel further contends that similarly placed co-accused Ashu @ Ash Mohammad has been given the benefit of interim pre-arrest bail vide order dated 26.12.2023 passed in CRM-M-63916-2023 (Annexure P-8). Similarly another co-accused Ahmad Khan was granted the same benefit vide order dated 02.01.2024 passed in CRMM-65547-2023 (Annexure P-9). Notice of motion.
